LOL or WTF?: School Photographer Covers Kid's Face With Smiley Face

Is this something to get mad at, or laugh at
Offensive or hilarious?
A 2nd grader at Sawgrass Elementary in Broward County, Florida is probably going to be subject to humiliation for rest of his days at the school.
Because his mother didn't sign a consent form to have him in a class photo, he had to be removed from the picture before it was published. Because this kid was sitting front and center, he couldn't be Photoshopped out of the picture. So, the PTA gave the photographer David Claussen a clever suggestion. Cover his face with a cartoon smiley face.

Of course, the PTA denies the allegations, saying that the brown smiley face was all Claussen's idea.
Via statement:
The PTA notified photographer after finding out that a child didn't have a signed media release form from the parent.
[Claussen's company] Broward Schools Photography covered the child's face using an inappropriate sticker. The PTA disagrees with how the photography company handled it and worked with the photographer to have the picture retaken this Thursday.
Immediate action was taken on behalf of the PTA. We love and protect our children.'
The photo has been deemed offensive by other parents. What do you think? Is this something to get all racial about, or something to laugh at?
