1.) Be someone who they've been looking for for a long time and have done everything they can to find
2.) Be likely to commit the same crime again
3.) Be heinous enough that publicity could help find you
So essentially, if you don't strike the FBI as a popular guy and actually have the sense to chill out somewhere after you commit your crime, you're good.
Miller also talks of the list originally being conceived by J. Edgar Hoover over a card game bet.
